Ina Braden appeals the sex discrimination ruling stating that Judge Sorg does not have jurisdiction over this trial. Approving the appeal would mean that Judge Sorg would have to hear the case.

An appeal was filed in order for Judge Sorg to hear the sex discrimination case with Ina Braden. This class action law suit inloves many faculty members at Pitt, but it was prevoisly denied hearing over its jurisdiction and Pitt's involvement.

Ina Braden's appeal for the sex discrimination case gets approved and will be heard by Judge Sorg. It was decided that Pitt is an arm of the state and as a result it is under federal court.

Approval of the appeal will allow for the sex discrimination case to be heard under Judge Sorg in federal court. Pitt can choose to respond to the approval of the appeal or accept and move forward. What Braden hopes to get out of the trial is for Pitt to implement non discriminatory practices.

Over the course of many years, jurisdiction of the Braden trial has been determined. Pitt is found to within state affairs and can be found under federal court and laws.

The class action law suit filed under the Civil Rights Act of 1871 has been found to within the grounds of this case by Judge Sorg. Pitt has been found to within state affair; therefore, is an agent of the state. This finding from the U.S. Court of Appeals for the Third Circut gave Judge Sorg enough to accept it. Pitt attorney Arensberg has filed a petition to appeal this ruling.
